Two recent Federal COVID-19 vaccines mandates will have a potential impact for contractors and on the overall construction industry:

1. On September 8, 2021, President Biden issued an Executive Order requiring federal contractors to ensure that employees working on or under a federal contract are vaccinated against COVID-19.
2. On November 4, 2021, OSHA issued a new COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS) mandating employers with 100 or more employees develop COVID-19 vaccination and/or testing policies for their employees. OSHA’s ETS has been temporarily stayed by a Federal Court, but could have future impacts once resolved.
