That all depends on the Equal Employment Opportunity Commission’s (EEOC) definition. Currently, penalties for not complying with an employer wellness program can be up to 30% of the lowest-cost employee-only plan that your company offers. That will change in the near future when a portion of the EEOC wellness regulations are vacated on January 1, 2019.
